Hereinafter referred to as "The Seller"

On the one hand:

Any natural person declaring to have the full legal capacity to engage under these terms and conditions i.e. to have the legal majority and not be under guardianship or trusteeship.

Hereinafter referred to as "The Customer"

Besides selling items on this website is exclusively reserved for retail sale and individuals.

ARTICLE 1 : OBJECTS

These terms and conditions specify the rights and obligations of the parties with respect to the products on the site www.hypolyne.com in the remote sales system.

These conditions of sale are governed by the current regulations and the Consumer Code.

However, the Seller reserves the right to correct these conditions at any time and without notice.

The order implies the adhesion to the general conditions of sale, ticking the box "I read and accept the general conditions of sale". The sales contract is concluded upon acceptance of these general conditions of sale on the suspensive condition of payment of the order if the customer pays by paypal.

ARTICLE 2: PRODUCTS

The products offered for sale by HYPOLYNE PARIS are those listed on the website www.hypolyne.com on the day of its consultation by the user and within the limits of available stocks.

Products are described and presented with the greatest possible accuracy, however color variations may occur. Furthermore, the photos illustrating the products of this site are not contractual.

HYPOLYNE PARIS agrees to comply with the orders received only within the limits of available stocks.

HYPOLYNE PARIS incurs no liability in the event of insufficient inventory or unavailability of products, a notification will be sent when the product is temporarily unavailable.

ARTICLE 3: PRICE

Prices are in Euros excluding transport costs.

HYPOLYNE PARIS reserves the right to modify its prices at any time and without notice. The products will be billed based on the rates in effect at the time of registration of the order, i.e. the one indicated on the site www.hypolyne.com except typographical error of which HYPOLYNE PARIS would not be responsible.

ARTICLE 4: ORDER

The customer after having identified himself and having filled the form, and check the order, will confirm the order. The order confirmation will be done by e-mail at the moment or later at the time of delivery. The order will be executed at the latest in a delay of 4 days from the day following the order if the product is in stock.

We do our best to make deliveries as soon as possible.

In case of impossibility of the ordered product particularly because of our suppliers, the customer will be informed as soon as possible and will have the possibility to cancel the order.

He can then ask for the refund of the amount paid or the exchange of the product.

ARTICLE 5: DELIVERY

Products are shipped to the address provided on the order form. The customer must verify this information because the Seller will not be held responsible for any typing errors that may cause delay or error of delivery.

If this was the case all costs incurred for the return of the order would be the responsibility of the Customer.

Delivery is made in France by colissimo and by UPS for the foreign countries. Our products are sold from the headquarters and travel at the risk of the buyer (Article 100 of the Commercial Code) even if shipping costs, including insurance, is advanced by our company, on your behalf. We decline any responsibility as for longer time-scales of the delivery times because of the carrier notably in case of loss of products or strike. Any anomaly concerning the delivery (damaged package, broken product) must be indicated on the delivery note in the form of "handwritten reserves" with the signature of the buyer and confirmed by mail to the carrier within two days of delivery, by registered mail with acknowledgement of receipt.

The shipping prices are calculated according to the weight of the package and the destination, according to the scales in force by the postal services.

ARTICLE 6: EXCHANGE/RETURN

The Customer has a right of withdrawal for the following reasons, non-satisfaction about the product, non-conformity of the product.

The Customer will have 14 days to change his mind and return the item to us in its initial state.

In both cases the Customer will benefit from an exchange of products or a refund.

The product must be in perfect condition, should never be worn, and must be in its original packaging. The right of withdrawal can not be exercised if the product is damaged or soiled by the Customer. And be accompanied by its original sales receipt.

If the above conditions are fulfilled and if the Customer has requested the refund of the product, HYPOLYNE PARIS commits itself to refund the sum corresponding to the purchased product within a period of fourteen days from the date on which the product has been received by HYPOLYNE PARIS.

ARTICLE 7: FORCE MAJEURE

The HYPOLYNE PARIS company has for all stages of access to the site, from the ordering process to the delivery, an obligation of means. The responsibility of HYPOLYNE PARIS can not be engaged for all the inherent damages of the Internet network, in particular rupture of service, an external intrusion or the infection by computer virus. Furthermore the Seller would not be responsible for the total or partial non-performance of its obligations under this contract, if the origin of this non-performance is a case of force majeure (out of stock with our suppliers, disturbances or strikes of postal services, fire, floods, earthquakes and generally in case of events beyond his control).

Beyond a delay of thirty days of interruption of deliveries due to force majeure or similar case, the Seller reserves the right not to honor the order, his responsibility is to refund the customer within thirty days following the cancellation.

ARTICLE 8: PERSONAL DATA

The personal data concerning the Customer are registered by the Seller within the limits necessary for the performance of its contractual obligations.

According to article 32-I-6 ° of the law of January 6, 1978, the information collected on the customer form is recorded in a file computerized by HYPOLYNE PARIS to manage the purchase on line and the loyalty of the Customer. They are kept for 5 years and are intended for the management.

The Seller agrees not to disclose, resell, or generally not to use personal data about the customer for purposes other than the performance of this contract.

In accordance with the Data Protection Act, the Customer has the right to exercise his right of access to data concerning him and have them rectified by contacting:

ARTICLE 9: INTELLECTUAL PROPERTY

The products presented on the site as well as the contents (photos, texts, images) are protected by copyright. Any representation or reproduction in whole or in part without the consent of the author or his heirs or assigns is unlawful. It is the same for translation, adaptation or transformation, arrangement, or reproduction by any art or process.

ARTICLE 10: APPLICABLE LAW

The general conditions of sale and this contract are governed by French law.

For all our customers, disputes that can not be resolved amicably will be the exclusive jurisdiction of the Commercial Court of Paris.
